Terms of Service

ByeByePromo helps you understand why your emails are filed into Gmail’s Promotions tab and how to land in Primary. The Service sends test emails, reports which Gmail category they land in, and generates suggestions to improve the email content you provide.

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for activity under your account, and for keeping your credentials secure. You must connect and test only email accounts you own or are authorised to use.

You agree not to:

• use the Service to send spam, unlawful, deceptive, or harmful content;
• connect accounts or test against recipients without proper authorisation;
• attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the Service or its underlying systems;
• violate any applicable law or the terms of any third-party service we rely on.

You retain ownership of the email content and other materials you submit to the Service (“Your Content”). You grant us a limited licence to host, process, and transmit Your Content solely to operate and provide the Service to you — including sending it as a test email and sending it to our AI provider to generate rewrite suggestions. You are responsible for ensuring you have the rights to submit Your Content.

The Service integrates with third-party providers (including Google, Clerk, Supabase, Resend, Anthropic, and Stripe). Your use of those integrations may also be subject to their terms. Our access to and use of data from Google APIs is described in our Privacy Policy and adheres to the Google API Services User Data Policy, including the Limited Use requirements.

Paid plans are billed in advance through our payment processor on a recurring basis until cancelled. You authorise us to charge your payment method for applicable fees and taxes. You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. We may change pricing with reasonable notice.

The Service, including its software, design, and content (excluding Your Content), belongs to Sefirot Srl and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

Gmail’s categorisation is controlled by Google and can change at any time. While we work to give you accurate, useful results, we do not guarantee any particular inbox placement, deliverability, or business outcome. The Service is provided for diagnostic and informational purposes.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the maximum extent permitted by law, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Sefirot Srl will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. On termination, the rights granted to you under these Terms will end.

These Terms are governed by the laws of Italy, and the courts of Turin, Italy will have jurisdiction, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
